Apple FTW, German Court Upholds Galaxy Tab 10.1 Sales Ban

Thorsten Karge · Berlin, Germany
In the past apple was always leading by innovation. Now that their visionary is gone, they have to defend their assets like every other patent troll.

Was the Galaxy Tab available or for sale in Germany before the iPad? Still seems like innovation to me. A good example to note would also be how much different the Xbox 360 and PS3 cases look, although they attempt to perform the same tasks. Both innovated in their design. Samsung copied.

If you mean copied a black bezel surrounding a screen of a significantly different aspect ratio and size, yes Samsung copied.

But then Apple copied tons of TV designs in the first place. Many of which were by Samsung.

Raveesh Bhalla - Samsung makes handheld touchscreen TV's? Thats just confusing. Having a monitor is not trademarked design. And yes, that's exactly what Apple means. Say Kia Motors took the design of the Ford Focus car, made it 8 inches longer and 4 inchs wider, even though it has a different interior and engine, and attempted to sell it. That would be illegal and copying as well. If you write a paper, and I add a few of my own words and call it my own, while they are not exactly the same thing, that is still plagiarism.

Given the "detail" in the registered design (I suggest everybody click through the link), the only way to produce a tablet that "differentiates itself" from the iPad would be to make it diamond-shaped.

Actually, maybe that's the key.. in all adverts from now on all Samsung tablets are shown turned 45 degrees on it's side. It's nothing like an iPaid, see? see? :)

Yeah. This community design patent is a complete joke. Perhaps you could go with unrounded corners, because, you know, users love sharp points...

the whole point is yes, the iPad is a particular look, Samsung WOULD NOT HAVE A TABLET at all without seeing and copying the iPad... EVEN THE SHIPPING BOX IS A DIRECT COPY... so yes a Tablet is a copy of the iPad, which is by the way, violating design patents, and tech patents...

that is the point of the patent system, so you can create a product, and sell it exclusively without some korean company copying it...

diamond shape or not... Samsung does not have the right to make a "tablet", nor would they have, because they would have never made a tablet in the first place, they only created a tablet to "copy" the iPad...

As an iPad 2 owner and user I have to say this blows. I want the competition and the reason Apple is having to fight hard on this one is that the iPad is lacking in way to many areas right now mine is working more as an e-reader then anything else.

Samsung deserves to lose, sorry but have you used one of these? It feels and looks like a cheep rip off of all things iPad. You can tell the UI engineers took their iPads and said hey lets copy this. From the EXACT SAME ICONS, with the SAME GLOSS, to the SAME DOCK, to the SAME animations, everything they did including the hardware was rip off of Apple. It's clear they think they can ride on Apple's innovation instead of spending money on R&D and making their own innovations.

oh right, paid off the Samsung judge, the HTC judge, the Oracle judge, the Dutch judge... and soon the California judge.... right....... all the judges came together and agreed on what they wanted as a pay off too.... when they went into their local mobster union office....

Such nonsense - so the Galaxy looks kinda like an iPad. And every brand of flat screen TV looks really similar to each other. And so do many computer monitors. And cameras. And laptops. And blu-ray players. If you want a minimalist design you can only do so much...

LOL Samsung might have done better than saying that about having Galaxy Tab 10.1 shelved owing to this lawsuit. Its analogous to stating that "Hey we can't do shit about this so please buy Note Instead".

Lame indeed, didn't expect them to be so low and so weak at replying to this.

I just got a $829.99 iPad2 for only $103.37 and my mom got a $1499.99 HDTV for only $251.92, they are both coming with USPS tomorrow. I would be an idiot to ever pay full retail prices at places like Walmart or Bestbuy. I sold a 37" HDTV to my boss for $600 that I only paid $78.24 for. I use Bidsget.com.

This is west vs east thing. Nothing more.. The judge in Germany supports Apple becasue the case files are in the format that he expects. But anyway they can't stop Samsung and they will kiss their huge profits goodbye at some point.

Well, i guess the only reasonable response to this can be banning Apple products from homes of German customers until Apple starts competing again using real innovation and marketing, not court room racketeering. This is ridiculous, considering "great arists steal" history. I wonder if Xerox still could strike back and put down all Windows and MAC OSs of the world to sword... ?

They only opened up a new market last year with the iPad, one that Samsung and other have profiting from. But no, Apple is all about "court room racketeering" and zero innovation.

New time Samsung shouldn't say they're going to redesign their tablet after a competitor's presentation. Look at Sony, if can't figure out a way to make a tablet not look like the iPad.

João Guilherme Sousa , you are blinded by your shortsighted fanboyism. As for Apple being sued, i all looks like one thug being bullied by another. And you know what - I'd prefer Apple design products in a way customers chose them over Samsung, not because Apple managed to ban Samsung at all. To YOUR benefit, short-sighted Apple fanboy.
