Kickstarter will have no problem in litigation. They can file for an "improvement patent" and redact the direct infringement. They will easily come up with clever ways to say it improves the crowd-source environment in it's niche.

I took a quick look on the USPTO PAIR system at the history of the patent application that led to this patent. It went through four rounds of: the examiner searching, finding relevant references, the examiner rejecting and the applicant arguing/amending. About a dozen patents, patent applications and industry articles in total were dug up by the examiner and needed to be addressed by the applicant. To read through all of it and form an opinion as to the logic and rigor that was or wasn't applied is a several hour task (that I am not planning on doing).

There is no such thing as an obvious invention anymore. All inventions are obvious once they've been invented, so restricting patents for obviousness would eliminate all patents.
